
The Customary Court of Appeal, sitting in Ado-Ekiti, has set aside the Judgement of it lower court sitting in Ikere, over the ownership of a family land of Elemo Oke of Uro Quarters in Ikere-Ekiti.
The Judgement followed an appeal filed by Pa Micheal Amire, Chief Moses Obasua, Mr. Francis Aruleba and Mr. Joshua Jegede against the judgement of the Trial Court.
Respondents in the suit are; Mr. Oke Adebayo, Mrs. Muyibat Daramola and Mr. Jimoh Mukaila.
The appellants prayed the court to determine whether the Respondents had been able to prove ownership of the land in dispute.
Delivering his Judgement, Justice Lawrence Ojo allowed the appeal on the ground that the land was alienated without the consent of the head of the family and other principal members of the family.
Other members of the panel, Justice Olufolakemi Ogundele, and Justice Rotimi Adegboye agreed with the lead Judgement.
