Oyebanji floors Ojo at Federal High Court

The Federal high court sitting in Ado Ekiti has dismissed the case challenging the candidacy of Ekiti Governor elect Biodun oyebanji.

The court presided over by Justice Babs Kuewumi held that the plantiff failed to fulfill all court processes in compliance with the high court practice direction.

Justice Babs Kuewumi, in his judgement ruled that the writ of summons and statement of claims of Ojo were defective.

He consequently struck out the case and agreed with the Oyebanji’s counsel that the discrepancies in the originating processes had rendered the case academic.

The judge noted that the names of counsel on the Plaintiff’s originating summons and statement as well as the Nigerian Bar Association (NBA) stamp ran contrary which was against the law rendering the suit defective and incompetent.

Counsel to the defendants, Kabiru Akingbolu in an interview with BSES hailed the judgement describing it as a victory for all members of the party

He explained that the candidate of the party was validly nominated, and that the Governorship primary election was conducted in compliance with the Constitution of the Federal Republic of Nigeria, the Electoral Act 2010 as amended, as well as the guidelines of the party .

Counsel to the plaintiff, Alex Izinyon (SAN) who was represented by Ogunmoroti declined comments, stressing that he was not the lead counsel in the matter.

Security in and around the court premises were tight, as operatives of the Department of State Services (DSS) and the Nigeria Police stationed their vehicles around court as well checked vehicles and individuals entering the premises.
